1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must not access or use the Service.

Broker-Consumer Relationship. By using the Service, you acknowledge and agree that your use of the Service and any of its features constitutes entry into a lawful broker-consumer relationship with SHIJIE SITU, RealtyAI Plus Inc., Brokerage. This broker-consumer relationship is established at the moment you first access the Service and continues for the duration of your use. Nothing in this relationship obligates you to retain SHIJIE SITU, RealtyAI Plus Inc., Brokerage for any real estate transaction; the relationship is established solely to satisfy MLS® Rules and Policies that require a broker-consumer relationship before certain data (including sold-listing information) may be displayed to you.

Consent to Receive Communications. By using the Service and/or by providing your contact information (including but not limited to your email address and phone number) through the Service, you expressly consent to receive communications from us, including but not limited to SMS messages, WhatsApp messages, emails, and other electronic communications related to your use of the Service, property information, transaction updates, marketing content, and other notifications as further described in our Privacy Policy.

2. Description of Service

Our Service is a real estate search and market intelligence platform that enables users to browse residential property listings, view property details, photos, and historical MLS® listing data, interact with conversational assistants, and access automated property valuations.

Intended Users. The Service is intended for non-commercial buyers and sellers of real estate. By using the Service, you represent that you have a bona fide interest in the purchase, sale, or lease of the type of real estate offered through the Service.

3. MLS® Data Usage and Restrictions

Property listing data displayed on this website is obtained from participating local real estate boards. By using the Service, you agree:

• All MLS® listing data is provided for your personal, non-commercial use only.
• You may not copy, reproduce, redistribute, retransmit, or publish any MLS® listing data.
• You may not scrape, crawl, data mine, or use automated means to extract listing data.
• You may not use MLS® data for any commercial purpose, resale, licensing, or derivative databases.

4. PropTX and TRREB Disclaimers

Data Source. Property listing data displayed in the GTA market is supplied directly by PropTX Inc., the technology and data services provider for the Toronto Regional Real Estate Board (TRREB), under license. This data is provided to RealtyAI Plus Inc., Brokerage as a member of TRREB.

TRREB Ownership. You acknowledge and agree that TRREB and its members own and retain all proprietary rights and copyright in the MLS® database, System, and all Listing Information. You acquire no ownership rights in any of the listing database by using this Service.

Restriction on Dissemination. You may not directly or indirectly display, post, disseminate, distribute, publish, transfer, sell, or sublicense any Listing Information to any other individual or entity.

Virtual Office Website (VOW) Terms. This Service operates as a Virtual Office Website. You acknowledge that TRREB, its members, PropTX, and the brokerage operating the Service are not responsible for the accuracy of any information provided, and you should independently verify any information upon which you intend to rely.

5. CREA Trademarks

REALTOR®, REALTORS®, and the REALTOR® logo are certification marks owned by REALTOR® Canada Inc. and licensed exclusively to The Canadian Real Estate Association (CREA). The MLS® trademark and the MLS® logo are owned by CREA and identify the quality of services provided by real estate professionals who are members of CREA.

6. Estimates, Insights, and Editorial Content

All property valuations, estimates, market summaries, and conversational assistant answers generated by our tools are automated estimates for informational purposes only. They do NOT constitute a professional appraisal, financial, investment, legal, or tax advice. You should always consult a licensed real estate professional or appraiser before making financial decisions.

7. No Guarantee of Accuracy

The Service is provided on an "as is" and "as available" basis. Information displayed is deemed reliable but is not guaranteed to be accurate. All listing data originates from local real estate boards and is subject to errors, omissions, and changes. You are responsible for independently verifying any information before relying on it.

8. No Liability

To the maximum extent permitted by law, SHIJIE SITU, RealtyAI Plus Inc., Brokerage, and their affiliates shall not be liable for any direct, indirect, incidental, or consequential damages, or any loss of profits, data, use, or goodwill arising out of your access to or use of the Service.

9. User Accounts

Certain features of the Service require account registration. You agree to provide accurate information, maintain the confidentiality of your credentials, and take full responsibility for all activities that occur under your account. You may delete your account at any time through the app settings or by contacting us.

10. Prohibited Uses

You agree not to use the Service for any unlawful purposes, scrape or extract data using automated tools, gain unauthorized access to our systems, submit false information, or reverse engineer any part of the platform.

11. Intellectual Property & Commercial Use

We own all rights to the Service’s platform design, algorithms, branding, original content, and software. MLS® listing data is owned by the respective real estate boards. Any commercial use of the Service without our prior written consent is strictly prohibited.

12. Third-Party Services

The Service integrates with third-party service providers (such as Google Cloud, Firebase, and local real estate boards). Your use of these services is subject to their respective terms, and we are not responsible for any issues arising from third-party services.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, MLS® data misuse, fraudulent conduct, or extended inactivity.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the courts of competent jurisdiction located in Ontario, Canada.

15. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. In no event shall the aggregate liability of SHIJIE SITU or RealtyAI Plus Inc., Brokerage exceed the amount of one hundred dollars ($100.00).

16. Indemnification

You agree to defend, indemnify, and hold harmless SHIJIE SITU, RealtyAI Plus Inc., Brokerage, and their affiliates, officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

17. Modification of Terms

We reserve the right to modify these Terms at any time. When modifications are made, the revised Terms will be posted and the effective date will be updated. Continued use of the Service after changes constitutes acceptance.

18. Severability & Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force. These Terms, along with our Privacy Policy, constitute the entire agreement between you and us.
